The Projectionist - how did that get by Rohauer?

Does anyone know, how was the film The Projectionist able to use Keaton clips from Day Dreams? I thought Rohauer would have charged a price that an indie film like that could not afford. I don't know if the film was PD at that point but I'd also guess that that would not stop Rohauer from stopping use somehow....
